Wills and Bequests
Perhaps the easiest way for donors to assist the Greater Saskatoon Catholic Schools Foundation Inc. and our students is a bequest in their will. The Foundation is able to accept and provide charitable receipts for both cash bequests and gifts in kind. The attached clauses are intended to help professionals acting for clients who wish to make gifts to the Foundation through a will. Please feel free to modify as you see fit. The Foundation respectfully requests that lawyers and their clients be mindful of the need for flexibility when drafting a bequest. We would be pleased to discuss with donors and advisors the many initiatives within the Foundation where bequests can be directed. We do appreciate the opportunity to review the terms of Wills (especially for specific bequests) before they are finalized, so we can confirm our ability to accept and fulfill the intent of the gift.
Suggested Clauses for Gifts to the Greater Saskatoon Catholic Schools Foundation Inc.
I give and bequeath
a. the rest and residue (or share of residue)
b. the sum of ________ dollars
c. a specific property, security or asset
Above statement precedes ONE of the following options:
Bequest to general fund
to the Greater Saskatoon Catholic Schools Foundation Inc. at Saskatoon, Saskatchewan, for such educational purposes as the Board of Directors of the Greater Saskatoon Catholic Schools Foundation Inc. shall determine.
Endowment bequest to general fund
to the Greater Saskatoon Catholic Schools Foundation Inc. at Saskatoon, Saskatchewan, to be held as part of the Foundation's endowment funds and used for such educational purposes as the Board of Directors of the Greater Saskatoon Catholic Schools Foundation Inc. shall determine.
Bequest for a specific purpose
to the Greater Saskatoon Catholic Schools Foundation Inc. at Saskatoon, Saskatchewan to be used for the purpose(s) of ____________________. [the donor should identify the particular school programs, or area (e.g. curriculum development, scholarship program) that they wish to support.]
Endowment bequest for a specific purpose
to the Greater Saskatoon Catholic Schools Foundation Inc. at Saskatoon, SK, to be held as part of the Foundation's endowment with the interest to be used for the purpose(s) of _________________. [The donor should identify the particular school program or function (e.g. student financial assistance, child hunger) that they wish to support.]
Bequest of Specific Property
I give, devise and bequeath to the Greater Saskatoon Catholic School Foundation Inc. at Saskatoon, Saskatchewan, _____________________________________ (specify gift - land, artwork, collection, real estate, other assets) for the purpose of ____________________________________________.
I authorize my Executor to appoint, if necessary, a qualified appraiser to be approved by the Greater Saskatoon Catholic Schools Foundation Inc. to appraise the designated gift.
If my bequest is deemed to be not appropriate for the Foundation, I authorize my executer to sell the asset at auction or have it disposed of in like manner, and the money realized gifted to the Greater Saskatoon Catholic Schools Foundation Inc. for the above purpose.
Memorial
A clause naming the award or trust fund established by the bequest can accompany any of the above clauses.
Power to Vary Purpose Clause
Over time, a specifically named project may no longer exist as described in a Will or Trust. To ensure our ability to achieve the donor's objectives, and avoid future problems, we strongly recommend that the following paragraph be included in all documents that designate a specific purpose for the donation.
"In the event that circumstances make the specified use or administration of this gift no longer practical or desirable, the Board of Directors of the Greater Saskatoon Catholic Schools Foundation Inc. is hereby authorized to make changes in the use or administration of the gift to maintain, as much as is reasonably possible, its spirit and general intent."
